數(shù)據(jù)登記典型模式與實踐路徑分析

摘要: 數(shù)據(jù)的權屬問題是推進數(shù)據(jù)要素市場化配置改革的基礎性、關鍵性問題,數(shù)據(jù)登記是推進數(shù)據(jù)確權的有效路徑。通過對各地數(shù)據(jù)登記有關資料進行分析發(fā)現(xiàn),數(shù)據(jù)登記一般包括數(shù)據(jù)財產權登記和數(shù)據(jù)知識產權登記兩種典型模式,數(shù)據(jù)財產權登記路徑主要分為政府主導、企業(yè)主導和政企協(xié)同三種登記路徑,而數(shù)據(jù)知識產權登記主要由知識產權保護中心等事業(yè)單位主導登記。為充分發(fā)揮數(shù)據(jù)登記的作用,總結分析了數(shù)據(jù)登記的登記對象、登記結果、登記效力等方面的難點問題,并針對性地提出相關建議。

Analysis of typical models and practical paths of data registration

Abstract: The ownership of data elements is a fundamental and crucial issue in promoting the marketoriented allocation reform of data elements,data registration is an effective way to promote data rights confirmation。This paper starts from the study of the data registration in various regions,and finds two typical models of data registration: data property registration and data intellectual property registration.Data property registration are mainly divided into three types including government led, enterprise led, and government enterprise collaborative registration paths. Data intellectual property registration is mainly led by institutions such as the Intellectual Property Protection Center. In order to give full play to the role of the data registration, this paper also summarizes the difficult issues in terms of registration objects, registration results, registration effectiveness, and other aspects of data registration. Targeted suggestions for establishing standards, establishing platforms, and establishing institutions are proposed.

引言
為促進數(shù)據(jù)要素合規(guī)高效流通,從中央政策到地方試點均進行了不同程度的數(shù)據(jù)登記探索。《“十四五”國家知識產權保護和運用規(guī)劃》提出“研究構建數(shù)據(jù)知識產權保護規(guī)則”。《中共中央 國務院關于構建數(shù)據(jù)基礎制度更好發(fā)揮數(shù)據(jù)要素作用的意見》(以下簡稱“數(shù)據(jù)二十條”)提出“研究數(shù)據(jù)產權登記新方式”“建立健全數(shù)據(jù)要素登記及披露機制”。《數(shù)字中國建設整體布局規(guī)劃》提出“開展數(shù)據(jù)資產計價研究,探索推進重點行業(yè)數(shù)據(jù)資產登記”。在“數(shù)據(jù)二十條”出臺之后,不少省市推出數(shù)據(jù)登記制度,開展了“數(shù)據(jù)資產登記”“數(shù)據(jù)產品登記”“數(shù)據(jù)資產憑證”“數(shù)據(jù)資源公證”等有益探索,但往往只明確了數(shù)據(jù)要素的某一特定屬性,相關實踐中對登記的功能定位、登記對象、適用范圍等規(guī)則各不相同,尚未形成統(tǒng)一的操作指引。本文基于當前各地實踐,分析數(shù)據(jù)財產權登記和數(shù)據(jù)知識產權登記的登記形式、登記路徑等,分析數(shù)據(jù)登記在登記對象、登記效力、登記標準存在的問題,提出相關建議。
